1. Terms and Conditions

These terms and conditions of use set out the terms for use of the website www.languagebyexperience.com and the responsabilities derived from the use of its content i.a. educational programmes, graphical elements, drawings, designs, logos, signs, source code, object code, software, photographs, music, videos, tutorials, databases or information of any kind, and applies to all users of and visitors to the website

Therefore, the use of Langschool website implies full and express acceptance of the terms and conditions laid down herein. This is without prejudice to any further, more specific conditions that may apply to particular services or products offered through the website.

The user acknowledges that he/she has understood the information regarding the terms of use of the website and recognizes that the terms and conditions are sufficient for ensuring error-free operation, and therefore accepts the terms and conditions fully and expressly.

2. Definitions

By accessing, browsing and/or using the Langschool website a person is considered a user who, by the very act of accessing, browsing or using the website, accepts the Terms and Conditions of use listed herein.

3. Services offered by third parties

Langschool, through its website, will be able to authorized third parties in order to publish or render its services. In these cases, Langschool will not be responsible for establishing the general or particular legal conditions in connection with the use, undertaking or contracting of these services, nor can be considered responsible for them.

4. Intellectual property rights

Langschool is the sole ownership of all the intellectual property rights and know-how on/ and related to the website (including but not limited to, trademarks, logos, trade names, texts, reviews and comments, images, graphics, designs, sounds, databases, software, flow- charts, presentations, navigation architecture and web page source codes).

Moreover, Langschool holds the legal exploitation license related to all intellectual property rights, know-how and image rights concerning and in connection with the content and materials of the website.

Under no circumstances does access to the website imply any authorization, waiver, transfer, license or assignment of all or part of such rights by Langschool, unless expressly provided otherwise.     Notwithstanding the above-captioned, the services provided by Langschool and third parties are subject to prior contracting of such services and the payment of the corresponding service fee in accordance with the provided particular conditions, on which the user will find all payment information particulars. The user must be legally capable of entering into contracts and must be of legal age in accordance with Spanish legislation (be at least 18 years of age)

    The Privacy Policy will apply in case the user provides personal data in order to access the content of the website or to contract the services provided by Langschool.

  2. The use of intellectual property rights, know-how and content of the website is strictly prohibited, as well as their total or partial reproduction, public communication/broadcast and/or distribution for profit or commercial purposes. Moreover, it is strictly prohibited their modification, alteration and/or any other use of the website.

  3. In case a registration process is provided by Langschool to access the website, the user shall provide valid personal data along with actual contact information. The user is responsible for keeping the received password private and confidential.

    In addition to the above, the user is responsible for the password custody, contacting Langschool in case of theft, loss or improper use by third parties. Otherwise, the user would be responsible for any consequences or damages they could cause due to an improper or fraudulent use.

Langschool is not liable, under any circumstances, for damages of any kind which may be caused by, but not limited to, the following issues: errors or omissions in the content, non-availability of the website or transmission of malicious viruses or programs in the content.

9. Applicable law and jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of Spain.

In the event of any dispute, both parties are subject, with express waiver of their own jurisdiction if applicable, to the Courts of the city of Girona, Spain.

This document sets out the particular terms and conditions under which we provide our languages and cultural courses listed on our website www.languagebyexperience.com and related website(s).

These particular terms and conditions, together with the general terms and conditions, privacy policy and cookies policy as published within our website, represent the entire contract (the ‘contract’) between you (the ‘user’) and Langschool SL (‘Langschool’) with respect to the above-captioned website(s) and the fee-based courses and services therein.

You are hereby informed that by visiting, becoming a customer or user of, booking or purchasing any of our courses or services you agree to be bound by the contract.

1. Information on Langschool

The site www.languagebyexperience.com is operated by the Spanish company Langschool SL

Our main business address is located in Girona, Spain, at Street Damià Estela i Molinet,no.6-8, 3o-1a, with VAT no.B55269971

2. The user

By contracting services and/or courses offered by Langschool the user warrants that:

  1. He/she is legally capable of entering into binding contracts; and
  2. He/she is at least 18 years old, and
  3. He/she is providing accurate and complete information.

3. Booking and enrolment process

The user must send to Langschool a written request (the booking written request), whether on-line, by post or fax, to book a course and its related services such as accommodation services, extra cultural or sport activities. If the booking is made by telephone, it must be confirmed in writing by the means listed above.

Langschool will confirm the admission to the course sending the user an official letter of invitation by email, as confirmation of admittance to the chosen course. The letter of invitation shall include a copy of the contract with an invoice or fee statement describing in detail the fees and costs due and payable.

The final enrolment will depend on Langschool receiving the confirmation of the payment settlement of the related fees and costs.

4. Fees, costs and payment settlement

The fees and costs will be as quoted on Langschool website at the time the user sends the booking written request, except in cases of obvious error. These fees and costs are inclusive of a sum representing Spanish VAT, where applicable.

Prices are subject to change at any time, but changes will not affect booking written requests in respect of which Langschool has already sent the user an official letter of invitation.

The user will be responsible for paying Langschool the course fees and related services costs as detailed in the forwarded invoice or fee statement unless the user cancels the course and services booking within the period of eligibility for a refund as in Clause 5.

Payment by the user via Langschool’s website is available by credit or debit card; although Langschool accepts other payment methods i.a. bank wire transfers. The user may contact Langschool in order to settle and confirm the payment of the fees and costs.

Langschool is not responsible for the user’s bank charges and thus, in the event that the bank charges Langschool a commission, this amount will be added to the user’s final invoice or fee statement.

The user will have no access to courses and/or related services before the entire settlement of the invoice or fee statement. In this respect, the user is allowed to make an initial deposit of five hundred (500) Euros as a provisional booking confirmation. However, in order to get a final confirmation from Langschool, the user must settle the remainder of the payable costs and fees 20 calendar days prior to the course start date.

5. Cancellations

The user may cancel a course booking at any time.

If the user is acting as a consumer, and the user cancels the course booking within 14 calendar days of receiving the official letter of invitation without giving any reason, the user is entitled to a full refund of the costs and fees paid.

Following the expiry of the 14- day cancellation period, the user is entitled to a 50% refund of the costs and fees paid if the cancellation request is placed by the user 15 calendar days prior to the course start date. This 50% refund type will be also applicable when the cancellation is made under circumstances outside those described for users acting as consumers.

To place a cancelation request, the user must inform in writing by sending Langschool an email to the following address: cancelations@languagebyexperience.com. Langschool will make the reimbursement using the same means of payment as the user used for the initial transaction, unless the user has expressly agreed otherwise.

The user will not have the right to cancel a course booking where the services have been fully performed.

6. Insurances

Cancellation fees-travel insurance may be taken out for all of Langschool courses and services with our partner ARAG. By opting for this insurance during the user’s enrolment, the user accepts ARAG’s insurance terms and conditions which are available on request and on our website.

Concerning health insurance, Langschool will provide with such accident- health assistance during the length of the course. Contractual clauses are available on request and on Langschool’s website.

7. User’s obligations

The user is the sole responsible to comply with all the conditions imposed in order to travel abroad such as i.a. obtaining a visa, customs formalities, etc.

The user is required to attend the classes, notify Langschool in case of absence and respect the rest of the users, teachers and staff.

The illegal use of drugs, alcohol abuse or offensive behavior towards other users, teachers and staff is considered unacceptable. In this respect, Langschool reserves the right to cancel a course and/or remove the user from the accommodation, without refund, in circumstances where the user is found to be in breach of Langschool’s code of conduct.

8. Written communications

Applicable laws require that some of the information or communications Langschool sends to the user should be in writing. When using Langschool’s website, the user accepts that communication(s) with Langschool will be mainly electronic.

Langschool will contact you by email or provide the user with information by posting notices on its website. For contractual purposes, the user agrees to this electronic means of c ommunication and the user acknowledges that all contracts, notices, information and other communications that Langschool provides to the user electronically comply with any legal requirement that such communications be in writing.

9. Notices

All notices given by the user to Langschool must be given to Ms. Adelaida Martín Cano at C/Damià Estela i Molinet, no.6- 8, 3º- 1ª, Girona (Spain) or adelaida@languagebyexperience.com.

Langschool may give notice to the user at either the email or postal address he/she provides to Langschool when placing a booking request.

Notice will be deemed received and properly served immediately when posted on our website, 48 h ours after an email is sent, three (3) days after the date of posting of a letter within Spain, seven (7) days after the date of posting of a letter outside Spain. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an email that such email was sent to the specified email address of the addressee.

10. Indemnification

The user agrees to indemnify, defend and hold harmless Langschool and its affiliates, partners, suppliers and employees from any and all liability, claims, costs or damages arising from the user’s use of Langschool’s website or the user’s breach of the contract and any of its terms and conditions.

In this respect, the user undertakes to use all services in accordance with the law, morality, good practice and public order, as well as the provisions of the contract.

11. Transfer of rights and obligations

The contract between the user and Lang school is binding on the user and Langschool. A person (natural or legal) who is not party (a third party) to this contract shall have no rights under the contract to enforce any term, provision or agreement of the contract.

The user may not transfer, assign or otherwise dispose of the contract, or any of his/her rights or obligations arising under it, without Langschool’s prior written consent.

Langschool may transfer, assign or otherwise dispose of the contract, or any of its rights or obligations arising under it, at any time during the term of the contract.

12. Force majeure events

Langschool will not be held liable or responsible for any failure to perform, or delay in performance of any of its obligations under the contract that are caused by events outside its reasonable control (force majeure events).

  1. Strikes, lockouts or other industrial action.
  2. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
  3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
  4. Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
  5. Impossibility of the use of public or private telecommunications networks.
  6. The acts, decrees, legislation, regulations or restrictions of any government.

13. Waiver

The user agrees that if Langschool does not exercise or enforce any legal right or remedy which is contained in the contract or which Langschool has the benefit of under any applicable law, this will not be taken to be a formal waiver of Langschool’s rights and that those rights or remedies will still be available to Langschool.

14. Severability

If any of these terms and conditions or any provisions of the contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will, to that extent, be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

If any part of these terms and conditions is held to be unlawful, invalid or unenforceable, that part shall be deemed severed and the validity and enforceability of the remaining terms and conditions shall not be affected.

15. Privacy

The user of the services and courses offered by Langschool undertakes to voluntarily provide personal data and expressly accepts Langschool’s automated processing and incorporation of such data into a file whose purpose is to facilitate the offering and provision of its services, a file which Langschool is responsible and which is registered in the General Data Protection Register.

Concerning such matter, Langschool will process information about the user in accordance with Langschool’s Privacy Policy and Cookies Policy. By using the site, the user consents to such processing and the user warrants that all data provided by she/he is accurate.

16. Entire agreement

These terms and conditions and any document expressly referred to in them represent the entire agreement between Langschool and the user in relation to the subject matter of the contract and supersede any prior agreement, understanding or arrangement between Langschool and the user, whether oral or in writing.

17. Amendments

Langschool reserves the right to make any amendmen ts that it considers appropriate to this contract without prior notice. These amendments may be made through its website and shall be legally binding to all users during the period of its publication on the website, except to users who made course(s) bookings requests under the previous terms and conditions, which shall remain applicable to them.

18. Law and jurisdiction

The present contract shall be governed and construed in accordance with the laws of Spain, which shall also be applicable for any eventualities that are not provided for in terms of interpretation, validity and execution.

Langschool and the user, expressly waiving any other jurisdiction, hereby agree to be subject to the Courts of the Spanish city of Girona for the resolution of any disputes that may arise from the existence, interpretation or application of the contract, except for the cases in which the user has the status of a consumer in accordance with related applicable laws.
